Terms of Service
Last updated: 14 October 2026
These Terms explain how Neri works when you use the Neri Art marketplace app or website. Neri is run by Neri Art Ltd ("Neri", "we", "us"). These Terms apply to Buyers, Sellers and anyone who uses Neri. By using Neri, you agree to these Terms.
1. About Neri
1.1 Neri is an online marketplace for buying and selling original artwork in the UK. We provide the platform, the payment process and related services.
1.2 The sale of an artwork is a contract between the Buyer and the Seller. Neri is not the seller and does not own the artwork. Neri is responsible for the services it provides to its users and for its own actions.
1.3 These Terms do not remove any legal rights that cannot lawfully be removed or limited.
2. Who can use Neri
2.1 You must be 18 or over to have a Neri account or to buy or sell artwork through Neri.
2.2 You must give us accurate and up-to-date information and keep your account details secure. You are responsible for activity on your account. We may ask for information or checks where reasonably needed for fraud prevention, payments or legal requirements.
2.3 You may normally have only one account. You must not create another account to get around a restriction or suspension.
3. Sellers
3.1 Neri is for individuals selling their own artwork. It is not for businesses, galleries, dealers or other professional sellers.
3.2 When you list artwork, you confirm that you personally created it, own the physical artwork, have the right to sell it, and are not selling it for someone else.
3.3 Traders may not sell on Neri. If your selling activity becomes a business or professional activity, you must tell us and stop selling on Neri. We may ask you questions or ask for evidence to decide whether you are acting as a trader, and we may restrict or suspend selling if we reasonably believe you are.
4. Artwork and listings
4.1 Artwork listed on Neri must be original work created by the Seller. You must not list mass-produced prints, reproductions, copies, traced or substantially copied work, work made by someone else, stolen or forged work, or work created for you by another person.
4.2 AI-generated artwork is not allowed where generative AI has materially created the final artwork.
4.3 Listings must accurately describe the actual artwork, including its price, size, materials, condition, any important damage or defects, framing and any other information a Buyer would reasonably need. Images must not materially mislead Buyers.
4.4 Sellers must not list artwork they no longer have or have already sold.
4.5 Artistic nudity is allowed. Sexually explicit or pornographic content is not allowed anywhere on Neri, including in listings, images, profiles, messages and reviews.
4.6 We may hide or remove a listing where we reasonably believe it breaks these Terms, may infringe someone's rights, may be stolen or misleading, or where action is reasonably needed to protect users or Neri.
5. Buying artwork
5.1 A Buyer buys artwork from the Seller, not from Neri. A sale is made when the Buyer places the order, payment is successfully authorised or received, and Neri confirms the transaction.
5.2 If a Seller needs to cancel a paid sale, they must contact us (see section 21). We will cancel the sale and refund the Buyer in full. Sellers should only cancel for a genuine reason; repeated or unjustified cancellations may lead to restrictions.
5.3 Neri may pause or cancel a transaction where reasonably necessary because of suspected fraud, payment problems, account security, authenticity or ownership concerns, a serious breach of these Terms, or a legal requirement.
6. Fees and payments
6.1 Selling on Neri is free. Buyers pay Neri a service fee of 10% of the artwork price. The service fee is never charged on postage. The price you pay, including the service fee (and postage where it cannot be avoided), is shown with each listing, and the full breakdown is shown again before you pay.
6.2 Sellers receive the full artwork price plus any postage they charge.
6.3 We may change our fees for future transactions. We will give reasonable notice of material changes. The fee that applies to a sale is the one in effect when the Buyer pays.
6.4 Payments are processed by Stripe. Neri never sees or stores your full card details. You must use the payment process provided by Neri and must not move a transaction off Neri, for example to avoid fees or the protections in these Terms.
6.5 When a Buyer pays, the Seller's share is passed to the Seller's Stripe account straight away, and Stripe pays it out to the Seller on Stripe's payout schedule.
6.6 If a sale is refunded because of something the Seller did or failed to do (for example, not sending the artwork or not making it available for collection), or a payment is reversed or charged back, the Seller must repay their share. We may recover it from the Seller's Stripe account, including from future sales, subject to applicable law.
6.7 When we refund a Buyer in full, the refund includes the service fee.
7. Delivery
7.1 The Seller is responsible for safely packing and sending the artwork. Any postage charge is shown before payment.
7.2 The Seller must send the artwork within 10 days of payment and mark the order as sent in the app. If the artwork has not been sent within 10 days of payment, the Buyer may ask us to cancel the sale and we will refund the Buyer in full.
7.3 The Seller must use suitable packaging and provide tracking where available.
7.4 Buyers must provide a correct delivery address, and should confirm in the app when the artwork arrives.
8. Collection in person
8.1 Some Sellers offer collection instead of, or as well as, delivery. Collection orders must be paid through Neri at checkout. Sellers must not hand over artwork until the app shows the order as paid, and must not accept payment in any other way.
8.2 The Buyer and Seller should arrange the time and place of collection using Neri messages. Collection should take place within 14 days of payment unless both agree otherwise.
8.3 The Buyer should check the artwork when collecting it. If it does not match the listing, the Buyer should not accept it and should report the problem in the app. This does not affect your legal rights for problems that were not reasonably visible at collection.
8.4 The Seller should mark the order as handed over and the Buyer should confirm receipt in the app. Once the artwork is handed over, the Buyer is responsible for transporting it.
8.5 If the Seller does not make the artwork available for collection, or the Buyer does not collect it within the agreed time, we may cancel the sale and refund the Buyer in full. Section 6.6 applies where the Seller did not make the artwork available.
8.6 For your safety, we recommend meeting in a public place where practical, or bringing someone with you. Neri does not attend collections or verify users' identities.
9. Problems with an order
9.1 If your artwork does not arrive, is not as described, arrives damaged, or something else goes wrong, report it from the order in the app as soon as you can.
9.2 We review every report. We may ask the Buyer and the Seller for information or photos. We then decide the outcome, which may include a full or partial refund, and we tell you our decision by email.
9.3 Our decision on a report does not affect your legal rights.
10. Change of mind and consumer rights
10.1 A genuine private sale between two individuals does not automatically give the Buyer a 14-day change-of-mind cancellation right.
10.2 If a Seller is legally acting as a trader, different consumer rules may apply, including cancellation rights. Calling yourself a private Seller does not decide your legal status.
10.3 Nothing in these Terms removes legal rights relating to faulty, misdescribed or otherwise non-compliant goods or services.
11. Intellectual property
11.1 Sellers keep the copyright and other intellectual property rights in artwork they create, unless they have transferred or licensed those rights elsewhere.
11.2 Buying an original artwork gives the Buyer ownership of the physical artwork, not the copyright in it.
11.3 By uploading content to Neri, you give Neri permission to host, display, resize and use that content as reasonably needed to operate Neri, show listings and promote Neri and its marketplace. You keep ownership of your content.
11.4 The Neri name, branding, software and platform design belong to Neri or its licensors. You must not copy or commercially use them without permission.
12. Things you must not do
12.1 There is no tolerance for objectionable content or abusive users on Neri. You must not post anything that is abusive, harassing, threatening, hateful, sexually explicit, defamatory, infringing of anyone's rights or otherwise unlawful, whether in listings, images, profiles, messages or reviews.
12.2 You must not use Neri to sell artwork you did not create or do not own, sell stolen or forged artwork, infringe someone else's rights, provide false information, commit fraud, abuse or threaten another user, manipulate reports or disputes, avoid Neri's fees or the protections in these Terms, upload harmful software, interfere with Neri's security, evade account restrictions, or use Neri for any unlawful activity.
12.3 We may remove content or restrict an account where we reasonably believe these rules have been broken.
13. Reviews
13.1 Buyers can review a Seller after a purchase. Reviews must be honest and about your own experience of that purchase.
13.2 We may remove reviews that break these Terms.
14. Reports, blocking and complaints
14.1 You can report a listing, message or review from within the app, and you can block any user at any time. Reports must be made honestly and in good faith.
14.2 We review reports of objectionable content and abusive users within 24 hours. We remove content that breaks these Terms and remove the users responsible.
14.3 We may investigate any report, ask for evidence, contact the Seller, hide or remove a listing, or restrict an account where reasonably necessary.
14.4 If you believe artwork on Neri infringes your copyright or another legal right, contact us using the details in section 21.
15. Suspension and ending accounts
15.1 We may restrict, suspend or close an account where we reasonably believe there has been a serious or repeated breach of these Terms, fraud, false information, prohibited artwork, abuse of another user, an attempt to avoid fees or protections, or another significant risk to Neri or its users.
15.2 We may act without warning where reasonably necessary to prevent fraud or harm, protect users or Neri, or comply with the law.
15.3 You can delete your account at any time from within the app. Deleting your account does not cancel outstanding sales, refunds, disputes or amounts you owe.
15.4 We may keep records where reasonably needed to comply with the law, resolve disputes, prevent fraud or protect our rights. Our Privacy Policy explains what we keep and for how long.
16. Neri's responsibilities
16.1 Neri does not guarantee the value, quality, authenticity or condition of every artwork listed by users. We do not authenticate every artwork before it is listed.
16.2 Neri is not responsible for a Seller's description, ownership, artwork or failure to complete a sale simply because we host the listing. However, Neri remains responsible for its own services and promises and will meet the legal standards that apply to those services.
16.3 We aim to keep Neri working, but we cannot promise that it will always be available or error-free. We may pause it for maintenance, security or other reasonable reasons.
16.4 Neri may use third-party services such as payment, delivery, hosting and verification providers. Where the law allows, we are not responsible for a failure caused solely by a third party.
17. Liability
17.1 Nothing in these Terms excludes or limits liability that the law does not allow us to exclude or limit, including liability for death or personal injury caused by negligence, or for fraud.
17.2 Where the law allows, Neri is not responsible for losses caused solely by a Seller's actions, a Buyer's misuse of artwork, a carrier, or a dispute between a Buyer and a Seller.
17.3 Neri does not promise to be responsible for every problem that happens in a sale between a Buyer and a Seller. Our responsibility is limited to the services and obligations that are actually ours.
17.4 These limits apply only to the extent allowed by law and do not affect your statutory consumer rights.
18. Seller responsibility
18.1 A Seller may have to reimburse Neri for losses or reasonable costs directly caused by the Seller's fraud, deliberate wrongdoing, selling artwork they do not own, knowingly false information, infringement of another person's rights, or serious breach of these Terms, but only to the extent the law allows.
19. Legal and tax information
19.1 Neri may need to collect, check, keep or report information about Sellers and transactions to comply with the law.
19.2 Where required, we may report information to HMRC or another authority. Sellers must provide information reasonably needed for these legal requirements.
19.3 We may share information with regulators, courts, law enforcement, payment providers or other parties where the law requires or allows us to do so.
20. Privacy and changes
20.1 Our Privacy Policy explains how we use personal information.
20.2 We may improve, change or temporarily suspend parts of Neri.
20.3 We may update these Terms. For material changes, we will give reasonable notice. Changes will normally apply to future use and transactions, unless the law requires otherwise.
20.4 If you do not agree to an updated version, you should stop using Neri and delete your account. Your existing legal rights are not affected.
